Pricing, Availability, and Taxes
Unless noted otherwise, all prices shown are in U.S. dollars. These prices, unless specified otherwise, are not inclusive of taxes or charges placed on shipping and handling, which shall be treated as additional costs unless otherwise specified. All items are subject to availability, and we reserve the right to impose limits on order quantity. We also reserve the right to reject partial or entire orders, also well as the right to discontinue services or products without prior notice, even after you have placed your order. All prices are subject to change without prior notice. Likewise, because of factors such as changes in shipping rates, changes in tax, and differences between processor programs, all charges for shipping or taxes may adjust accordingly from the amounts shown on payment confirmation messages or payment checkout screens.
Responsibility for paying additional charges or fees, including but not limited to relevant use or sales taxes, governmental taxes such as duties, or other fees payable, shall fall to you, the customer. Should you neglect the fees or taxes that come with your transaction, you will still be held responsible for the payment of these should they be found to be payable. Gradcanada.ca reserves the right to collect the payment of these taxes or other fees from you at any time.
Please note that the cost of shipping is not inclusive of any costs for customs, and that there can be duties or additional fees placed on the order by the country of destination’s customs agency or by the company in charge of shipping. It falls to you, the customer, not Gradcanada.ca, to pay these fees or any additional costs to do with such fees, including fees placed on delivery delays. Because our shipping carriers do not provide information regarding such details as delayed delivery or customs fees, Gradcanada.ca cannot provide estimates on the costs or delays involved. Shipping carriers may occasionally notifyGradcanada.ca about packages being held for taxes and duties; however, we have no influence whatsoever towards your country’s import and customs agencies, and the responsibility towards payment of these fees falls towards the customer and not towards us. We welcome any advice for legal ways of mitigating or avoiding these fees and for helping to ensure a faster process. If, for example, you have an account number with the shipper where you would like the fees billed, or if you have any alternate addresses that should prove more convenient for you, or if you have any other legal arrangements that would help make the process easier on you, we would welcome any details or instructions to help facilitate this.
Overall, please anticipate any fees that you may encounter, such as shipping fees and import fees, and assume that any additional fees will be your (the customer’s) responsibility. However, we appreciate knowing of any legal methods of making the customs process more convenient and affordable for you.
Errors
We do our best to provide a service as accurate and as free of errors as possible, but cannot guarantee complete elimination of errors. As such, we do not claim that any service, product, description, image, pricing, or other information is reliable, complete, up to date, accurate, or free of errors.Gradcanada.ca reserves the right to correct any errors found, whether on the products, in the confirmation of an order, in the processing of an order, or in in the delivery of a product, service, otherwise. We also reserve the right to change orders accordingly (this includes changing the charge to the correct price), as well as the right to cancel orders and refund any charged amounts. Should an error occur, your best solution would be to cancel your order and then obtain a refund.
Pre-Orders
Gradcanada.ca may offer you the ability to order a product before it becomes available. This is known as pre-ordering. Should you choose to pre-order a product, we will charge you at the time of purchase and ship the product to you once it becomes available.
Out-of-Stock Items
Products are subject to availability. If your desired color, width, or size, do not appear in the relevant product information page, or in the relevant drop-down menu or selections, or if a notice appears on the product page informing you of a lack of stock in certain items, then the product in the configuration you desire is not currently available for purchase. Should you find that a specific product or a specific iteration of a product is currently unavailable, please check again later, as our inventory is subject to change.
Shipping, Handling, and Export
As mentioned previously in Pricing, Availability, and Taxes, prices shown on the site do not include fees for additional charges such as shipping unless otherwise specified. You, the customer, agree to check all charges before placing an order. Because of factors such as changes in shipping fees, charges displayed during checkout may or may not reflect actual costs, and Gradcanada.ca reserves the right to change charges on shipping and handling, whether by decreasing, increasing, adding, or eliminating them. Unless you the customer specify or direct otherwise, we will generally ship all products via standard ground delivery. All orders placed through the website are contracts for shipping, not contracts for destination. Any dates or times stated for shipping or delivery are only estimates, and the actual dates and times of delivery may vary. You, the customer, agree not to direct or obtain shipment of any product purchased through our website for export. To learn more about shipping and tracking your order, please read our Shipping and Tracking page.
Methods of Payment and Credit for Refunds
Currently, our products may only be purchased through acceptable payment methods such as valid credit cards. The valid credit card used to make a purchase is the same one the refund will be credited to should the need for a refund occur. By using the website to submit an order, you the customer state that you are authorized to use the credit card or other valid payment method used for purchase, and so give Gradcanada.ca the authority to charge that credit card or other method of payment for the amount needed to purchase your order. This includes additional fees such as shipping and handling, taxes, and any other additional fees that this website may describe. By providing your payment information to us, you give us the authority to process and store information about your payment and related to your payment. This same authorization would also go towards any third party service provider working on our behalf. If the method of payment or the credit card you used is found to be unacceptable (for example: it cannot be verified, or it is invalid), we reserve the right to automatically suspend or cancel your order. The responsibility falls to you to resolve any payment problem we encounter with regards to your order or orders. For more information on our methods of payment, please read our Payment Options page.

Arbitration
PLEASE READ THE FOLLOWING PARAGRAPH CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE DISPUTES WITHÂ GRADCANADA.CAÂ AND IT LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF.
You and Gradcanada.ca agree to arbitrate any dispute arising from these Terms or the sale and purchase of products or services from Gradcanada.ca, except that you and Gradcanada.ca are not required to arbitrate any dispute in which either party seeks equitable or other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets or patents. ARBITRATION PREVENTS YOU FROM SUING IN COURT OR FROM HAVING A JURY TRIAL. You and Gradcanada.ca agree that you will notify each other of any dispute within thirty (30) days of when it arises, that you will attempt informal resolution prior to any demand for arbitration, that any arbitration will occur in Seattle, Washington, and that arbitration will be conducted confidentially by a single arbitrator in accordance with the Rules of the American Arbitration Association. You and Gradcanada.ca also agree that the state or federal courts in King County, Washington have exclusive jurisdiction over any appeals of an arbitration award and over any suit between the parties not subject to arbitration. Other than class procedures and remedies discussed below, the arbitrator has the authority to grant any remedy that would otherwise be available in court. Whether the dispute is heard in arbitration or in court, you and Gradcanada.ca will not commence against the other a class action, class arbitration or other representative action or proceeding.
Severability
If any provision of these Terms are found to be unenforceable, unlawful, or for any reason void, then that provision shall be deemed severable from these Terms and shall not have any effect on the enforceability and validity of any remaining provisions.
